Terms of Service

By creating an account or using Chiar, you agree to these Terms. These Terms are a binding agreement between you and Chiar, Inc., a California corporation. If you do not agree, do not use the platform.

Chiar operates a marketplace where enrolled phone line owners (“Owners”) allow short pre-recorded advertisements to play for inbound callers, and businesses (“Advertisers”) pay per opt-in lead generated when callers press 1.

You must be at least 18 years old and legally authorized to form contracts in California. Business advertisers represent they are duly organized and authorized to use the platform.

4.1 By enrolling a number, you authorize Chiar to play pre-approved audio messages to inbound callers on that line.

4.2 Nothing changes about how you use or receive calls on your enrolled number.

4.3 You represent that you are the account holder or authorized user of any enrolled number.

4.4 Earnings are credited monthly. Minimum payout is $10. Chiar may withhold payment if fraud or policy violations are detected.

4.5 You may remove a number from the network at any time from your dashboard.

5.1 You are solely responsible for the accuracy, legality, and compliance of your ad content.

5.2 Ads must comply with all applicable laws including the FTC Act, TCPA, and applicable state regulations.

5.3 A lead is generated only when a caller affirmatively presses 1. Chiar does not guarantee any specific number of leads or business outcomes.

5.4 Subscriptions renew automatically each calendar month. Cancel anytime from your dashboard; cancellation takes effect at end of the current billing period.

5.5 Leads already delivered are non-refundable. Unused subscription leads do not roll over.

5.6 Pay-as-you-go wallet funds are non-refundable except where required by law.

Advertisers are solely responsible for TCPA compliance, the Telemarketing Sales Rule, the National Do Not Call Registry, and applicable state laws when following up with leads. See /tcpa for guidance.

You may not use Chiar to advertise:

• Illegal products or services
• Adult content
• Firearms or weapons
• Unlicensed gambling
• Multi-level marketing or pyramid schemes
• Content targeting persons under 18
• False, misleading, or deceptive offers

Chiar retains all rights to the platform and brand. You retain rights to your ad content. By submitting ad content you grant Chiar a limited license to reproduce and transmit it for delivery on the network.

The platform is provided “as is” without warranty of any kind. Chiar does not warrant uninterrupted availability, accuracy of lead data, or fitness for a particular purpose.

To the maximum extent permitted by law, Chiar's total liability shall not exceed the total amount you paid to Chiar in the 12 months preceding the claim. In no event will Chiar be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or business opportunities, even if advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Chiar and its officers, employees, and agents from any claim, loss, or expense (including reasonable attorneys' fees) arising from: (a) your use of the platform; (b) your ad content; (c) your communications with leads; or (d) your violation of these Terms or applicable law.

Chiar may suspend or terminate your account for material violation of these Terms with or without prior notice. You may close your account anytime from your dashboard. Sections 9, 10, 11, and 13 survive termination.

These Terms are governed by the laws of the State of California. Any dispute not resolved informally will be submitted to binding arbitration under JAMS rules in San Francisco, California. You waive the right to bring claims as a class or consolidated action.

We may update these Terms at any time. Registered users notified by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.
